A resident has a valid DoLS authorisation. One afternoon, they tell a member of staff:
“I want to go to the café across the road on my own.”
The care plan says the resident must be accompanied when leaving the home because they lack capacity to make decisions about their care arrangements.
The staff member replies:
“Sorry, you’re under DoLS. You’re not allowed to go out on your own.”
Another member of staff challenges this:
“Does the DoLS actually say they can’t go to the café? Or are we using the authorisation as a blanket reason to say no?”
The manager responds:
“We have to keep them safe. If something happened, we’d be blamed.”
But the resident understands where they want to go, knows how to get there and has previously made the journey safely
